These Booking Conditions and Terms of Service (the "Terms") govern reservations and purchases made from Wandering in
Asia & Beyond LLC (the "Company," "we," "us," or "our") by the person making the reservation and each traveler included in
that reservation (collectively, the "Client" or "you").
By submitting a reservation, paying a deposit or other amount, or purchasing travel services from the Company, you agree
to these Terms. If another person makes a reservation on behalf of additional travelers, that person represents that they are
authorized to accept these Terms on their behalf.
1. Deposit and Payment
1.1 Group-tour deposit
A deposit equal to 40% of the total land-package price is required to confirm a reservation on a group tour, unless the
written quotation or invoice states otherwise.
1.2 Final payment
The remaining land-package balance is due no later than 40 days before departure. If payment is not received by the due
date, the Company may treat the reservation as cancelled and apply the cancellation terms below, after any notice
required by applicable law.
1.3 Payment method
Payments are accepted by bank transfer unless otherwise agreed in writing. You are responsible for bank, wire-transfer,
intermediary-bank, and currency-conversion charges necessary to ensure that the Company receives the full invoiced
amount.
1.4 Booking confirmation
A reservation is confirmed when the Company has received the required deposit or other required payment and has issued
written confirmation, subject to supplier availability and any conditions stated in the confirmation.
2. Cancellation and Refunds
Cancellations must be submitted in writing by email. The cancellation date is the date the Company receives the written
cancellation. Refunds, if any, will be processed in accordance with these Terms and the applicable supplier rules.
For the land package, unless a written quotation or invoice states different terms:
•
More than 60 days before departure: the deposit is refundable less a non-refundable $200 USD administration fee.
•
60 through 41 days before departure: the cancellation charge is 30% of the total tour price, plus the $200 USD
administration fee. Any remaining amount paid toward the land package will be refunded.
•
40 days or less before departure: land-package payments are non-refundable, except to the extent a refund is
required by applicable law or expressly provided by the Company or a supplier.
Certain components may have stricter cancellation terms. If a quotation, invoice, airline fare rule, cruise rule, hotel rule, or
other written supplier condition expressly states a different cancellation or refund rule, that rule will apply to the applicable
component to the extent permitted by law.
3. Airline Tickets
3.1 Payment
Unless otherwise stated in writing, airline tickets require full payment when ticketed.
3.2 Fare rules
Airline tickets are governed by the fare conditions and policies of the applicable airline. Unless a fare specifically permits
otherwise, tickets may be non-refundable, non-transferable, or subject to change and cancellation fees.
3.3 Flexible fares and insurance
Where available, you may request a flexible fare or an applicable airline/travel protection product for an additional cost.
Availability and coverage are determined by the relevant provider.
3.4 Airline changes and claims
The Company may assist as a travel intermediary, but the airline controls its schedules, fares, ticket conditions, and
applicable refunds or credits. Any airline claim remains subject to the airline's rules and applicable law.
4. Baggage
Unless the itinerary or written quotation states otherwise, the tour price includes the baggage allowance specified for the
applicable airline itinerary, which may include:
•
one checked bag up to 23 kg (50 lbs);
•
one carry-on bag up to 10 kg (22 lbs);
•
one personal item.
Airline baggage rules and allowances can vary by route and fare and control where they differ from a general itinerary
description. Excess baggage charges are the Client's responsibility. Because some tours use smaller vehicles, boats, or
trains, luggage must be reasonably sized and capable of being safely accommodated.
5. Passports, Visas, and Travel Documents
You are responsible for obtaining and maintaining all travel documents required for your nationality and itinerary, including
a valid passport, visas, entry permits, health or vaccination documentation, and transit requirements. Many destinations
require a passport valid for at least six months beyond entry or departure; however, requirements vary and you must verify
the current requirements applicable to you.
The Company may provide general assistance or information but does not guarantee visa approval, entry, boarding, or
admission to any country. Government decisions, visa processing, passport issues, denied boarding, denied entry,
deportation, or changes in entry rules may affect travel and may result in charges under the applicable cancellation and
supplier rules.
6. Accuracy of Traveler Information
You are responsible for providing complete and accurate information required for reservations and travel documents,
including names exactly as shown on passports, dates of birth, nationality, passport details, and other requested
information. You are responsible for reasonable costs caused by information that you supplied incorrectly or incompletely,
except to the extent the cost results from the Company's own error or applicable law provides otherwise.
7. Health, Accessibility, and Fitness to Travel
You are responsible for assessing your ability to participate safely in the activities included in your itinerary and for
obtaining appropriate medical advice when needed. You should tell us before booking about any mobility, accessibility,
dietary, allergy, or other condition that may materially affect your participation so we can discuss whether appropriate
arrangements are available.
We will make reasonable efforts to communicate relevant needs to suppliers, but accommodations depend on destination
conditions and supplier capabilities. The Company may decline or modify participation when reasonably necessary for
safety or where a supplier cannot safely accommodate a disclosed need, subject to applicable disability and consumer-
protection laws. The Company does not provide medical services.
8. Travel Insurance
We strongly recommend comprehensive travel insurance appropriate to your itinerary, including coverage for trip
cancellation and interruption, travel delays, baggage loss or delay, emergency medical treatment, and emergency
evacuation. Insurance is provided by independent insurers, not by the Company, and coverage depends on the policy
terms. You are responsible for reviewing the policy and purchasing any coverage you need.
9. Travel Risks
International travel involves risks that may include illness, injury, accidents, transportation delays, lost or stolen baggage,
theft, political or civil unrest, terrorism, natural disasters, severe weather, changing government requirements, and
differences in local infrastructure or medical services. You acknowledge these inherent risks. Nothing in these Terms
excludes or limits liability that cannot lawfully be excluded or limited.
10. Travel Suppliers and Company Responsibility
The Company arranges travel services that may be provided by independent airlines, hotels, cruise operators,
transportation companies, guides, restaurants, excursion providers, and other suppliers. The Company's role may differ
depending on the service: for some services we act as an intermediary, while for other services we may package or sell
travel arrangements to you.
We are not responsible for a supplier's independent acts or omissions, or for events beyond our reasonable control, except
to the extent the Company is legally responsible for the travel services it sells, arranges, or contracts for. Nothing in these
Terms waives rights or remedies that cannot legally be waived.
11. Limitation of Liability
To the fullest extent permitted by applicable law, the Company will not be liable for indirect, incidental, special, exemplary,
or consequential losses arising from travel services, except where such liability cannot lawfully be excluded.
To the fullest extent permitted by applicable law, the Company's aggregate liability for a claim arising from travel services
will not exceed the amount actually paid directly to the Company for the specific travel service giving rise to the claim. This
limitation does not apply to liability that cannot lawfully be limited or excluded, including where prohibited by law or for the
Company's own gross negligence, willful misconduct, or other conduct for which liability cannot legally be disclaimed.
12. Force Majeure and Events Beyond Reasonable Control
The Company is not responsible for failure, delay, or changes caused by circumstances beyond its reasonable control,
including natural disasters, severe weather, war, terrorism, civil unrest, labor disruptions, epidemics or pandemics,
government actions, border closures, airline schedule changes, or transportation disruptions. Where reasonably possible,
we will assist in seeking available alternatives or refunds from suppliers, but supplier refunds or credits cannot be
guaranteed.
Where applicable law gives you mandatory rights in circumstances covered by this section, those rights remain unaffected.
13. Itinerary Changes, Pricing, and Tour Cancellation
We may make reasonable changes to accommodations, transportation, sightseeing, or daily itineraries when necessary for
operational, safety, supplier, weather, or local conditions. If a change materially reduces the value of the package, we will
provide any remedy required by applicable law.
If supplier costs increase before final payment because of fuel surcharges, taxes, government fees, exchange-rate changes,
or other costs outside our reasonable control, the Company may adjust the tour price where permitted by applicable law
and will provide notice. If a legally required right to cancel for a price increase applies, you may exercise that right.
Group departures may require a minimum number of participants. If the minimum is not reached, the Company may
cancel the departure up to 40 days before departure, unless a different period is stated in the written itinerary or required by
law. In that event, land-package amounts paid directly to the Company will be refunded in full. Airline tickets and other
supplier services remain subject to their applicable rules.
14. Traveler Conduct
The Company may take reasonable action, including removing a participant from a tour, when a participant's conduct is
abusive, threatening, illegal, materially disruptive, or creates a significant safety risk. Any removal will be handled
consistently with applicable law. Additional costs caused by the participant's conduct may be charged to the participant to
the extent permitted by law. No refund is guaranteed for unused services resulting from a participant's misconduct.
15. Accessibility
Accessibility standards and facilities vary significantly by destination. Travelers who need accessibility or mobility
accommodations should notify the Company before booking. We will make reasonable efforts to determine whether
requested arrangements are available and whether the itinerary is suitable, consistent with applicable accessibility laws.
16. Complaints and Claims
If a problem occurs during travel, please notify the Company or the relevant supplier as soon as reasonably possible so that
we have an opportunity to assist while the trip is in progress. Written complaints should describe the issue and the
requested resolution. Nothing in this section shortens a statutory limitation period or other mandatory consumer right.
17. Governing Law and Dispute Resolution
These Terms are governed by the laws of the State of Georgia, without regard to conflict-of-law principles, except to the
extent another law mandatorily applies to a consumer transaction. Any venue or jurisdiction provision is subject to any
mandatory consumer-protection or other law that gives you the right to bring a claim elsewhere.
Before filing a legal claim, the parties are encouraged to try in good faith to resolve the matter directly. Nothing in these
Terms prevents a consumer from exercising a non-waivable statutory right or pursuing a claim in a forum where applicable
law requires that the claim may be brought.
18. Seller-of-Travel and Regulatory Compliance
Travel-seller registration, disclosure, trust-account, bonding, or other requirements may apply depending on where the
Company sells travel and where a Client resides. The Company will comply with requirements that legally apply to its
activities. Because these requirements are jurisdiction-specific, the Company should obtain a current legal and regulatory
review before marketing or selling travel to residents of states or countries that impose seller-of-travel or package-travel
requirements.
The Company does not intend these Terms to waive or avoid any mandatory registration, disclosure, refund, accessibility, or
consumer-protection requirement.
19. Changes to These Terms
The Terms applicable to a booking are those provided or made available to the Client at the time of booking, together with
any written quotation or invoice incorporated into the booking. We may update these website Terms for future bookings.
Changes will not retroactively alter a confirmed booking except as permitted by the booking documents or applicable law.
